| School admission appeal where no prejudice established at the first stage of the appeal process: letter confirming place offered A specimen letter for use where the Appeal Panel concludes at the first stage of the appeal process that admitting another child would not prejudice efficient education or the efficient use of resources and therefore there is no need for the Appeal Panel to move on to the second stage of the appeal process. When using a standard form of letter to notify the parent or guardian of the outcome of an admission appeal, it is essential to bear in mind the judge's comments in R (C) v Appeals Panel of Nottinghamshire [2004] EWHC 2988 that the letter informing the appellant of the decision clearly sets out the grounds for the decision and addresses the individual reasons of the particular case. The specimen letter must be viewed as a starting point for drafting a decision letter and is no substitute for crafting a letter to meet the particular needs of the case. This will be essential where the case is unusual in some way. |
