| Positive overage covenant with restriction A positive overage covenant enabling a seller to share in any increase in value of a property where planning permission is granted after completion of a sale. Provision is made for a restriction to be entered against the buyer's title and for the creation of a chain of deeds of covenant with the buyer's successors in title. NOTE: This standard document will need modification to suit each transaction and must be read in conjunction with the accompanying drafting notes.See Standard clauses and drafting notes for clauses that can be used to adapt this document. |
| Deed of release of restrictive covenant This standard document is for use where a party agrees to release a restrictive covenant of which it has the benefit. There is no separate drafting note for this standard document but the web version of the document contains some integrated drafting notes, which draw attention to some of the most important issues. The integrated drafting note, "About this document", which appears underneath the Contents sets out the drafting assumptions. The standard document may be viewed with or without the integrated notes by using the options in the "Actions" box in the top right corner of the screen. | Acknowledgement to prevent acquisition of right of way by prescription This acknowledgement is intended to prevent the acquisition of a right of way by prescription. However, it may not be effective to prevent the prescriptive acquisition of a right of way based on 40 years' use under the Prescription Act 1832 in certain circumstances (see 40 years' use under the Prescription Act 1832). In these circumstances, practitioners should consider using Standard document, Licence to use a route over land instead, in order to prevent a prescriptive right of way arising. This acknowledgement contains integrated drafting notes which provide brief warnings, explanations and directions to assist with drafting and negotiation. | Deed of release and grant (of a right of way) This deed releases an existing right of way and grants a new (alternative) right of way. It is assumed that: The grantor owns the freehold interest in the servient property and the grantee owns the freehold interest in the dominant property. The grantor's title to the servient property and the grantee's title to the dominant property are each registered at HM Land Registry. Neither the servient property or the dominant property are subject to leases. The release and grant of the easements are in consideration of the payment of a capital sum by the grantee. | Deed of easement for overhead service media This deed of easement grants the right to pass service media over the grantor's land. It is assumed that: The grantor owns the freehold interest in the servient property and the grantee owns the freehold interest in the dominant property. The grantor's title to the servient property and the grantee's title to the dominant property are each registered at HM Land Registry. The grant of the easement is in consideration of the payment of a capital sum by the grantee. |
| Licence to use a route over land A licence from a landowner permitting a licensee to use a route over its land. This licence enables the licensor to permit the use of a route across its property, without granting an easement or a lease. It can also be used to prevent the acquisition of a prescriptive easement in the form of a right of way across the licensor's property. This licence contains integrated drafting notes which provide brief warnings, explanations and directions to assist with drafting and negotiation. It is assumed that: The grantor owns the freehold interest in the servient property and the grantee owns the freehold interest in the dominant property. The grantor's title to the servient property and the grantee's title to the dominant property are each registered at HM Land Registry. The grant of the easement is in consideration of the payment of a capital sum by the grantee. The deed includes optional wording for the relocation of the service media on notice at the request of the grantor. |
| Licence for access to land for environmental site investigations A licence permitting a buyer to carry out on-site environmental investigations prior to completion of a transaction. | Deed of easement: general rights This deed of easement can be used to grant simple rights over the grantor's land. It is assumed that: The grantor owns the freehold interest in the servient property and the grantee owns the freehold interest in the dominant property.
