| Part 36: Defendant's offer to settle This letter is an example of a defendant's Part 36 offer to settle. It can be used as a pre-action offer to settle a dispute or an offer to settle after proceedings have commenced. Making such an offer can constitute an effective means of putting pressure on the claimant to settle. The letter sets out all of the points necessary to comply with new Part 36, which came into force on 6 April 2007. |

| Settlement deed and release: an example This is an example of a settlement deed and release which could serve as a useful starting point when drafting a settlement deed. In order to ensure that a settlement deed achieves its purpose, it is necessary for the deed to be tailored to the particular circumstances of the matter in question. This specimen settlement deed should be read in conjunction with the Settlement agreement/deed: drafting note. You may find it helpful to refer to the Checklist of issues to consider on drafting a settlement agreement too. You will only need to execute a settlement agreement as a deed in certain limited circumstances, such as where there is no consideration passing between the parties. | Part 36: Claimant's offer to settle This letter is an example of a claimant's Part 36 offer to settle its claim. It can be used as an offer to settle after proceedings have commenced or as a starting point for drafting a pre-action offer to settle a dispute. It can be an effective way to put pressure on the defendant to settle the matter sooner rather than later, in light of the consequences (indemnity costs and interest) if it does not accept the offer and the claimant goes on to obtain a judgment which is equal to or more advantageous then the offer. |
